Purchase of Covid19 test kits in 2017_18 – a Freedom of Information request to Department of Health

Dear Department of Health and Social Care,

“Data from the World Integrated Trade Solution (WITS) show that in 2017 and 2018 the UK bought COVID-19 Test kits with the code 300215 and 902780 as Medical Diagnostic Test instruments, e.g. “COVID-19 Test kits (300215) exports by country in 2017. Top importers of COVID-19 Test kits are European Union ($17,131,541.68K, 2,759,970 Kg), Germany ($8,731,545.89K, 3,015,010 Kg), United States ($7,927,894.38K, 2,627,050 Kg), United Kingdom ($6,291,366.96K, 1,062,590 Kg)”. In 2018 the UK Govt bought said test kits under HS Code 902780 as 453,206.36 items each with a Trade Value of 1000USD. Said bought Medical Test kits/ Instruments, apparatus used in Diagnostic Testing are now classified by the World Customs Organization as critical to tackling COVID-19.

Please will you provide of above mention test kits purchases; the records, including:
1. The names of those involved in said purchase of test kits (code 300215 and 902780);
2. When these test kits have been used,
3. The validity and reliability of said tests;
4. Its relationship to the current used PCR tests;
5. Whether said purchase is related to meetings with CEPI, WHO, WB, Bill Gates, the IHR (2005) and/or the Global Preparedness Monitoring Board;
6. How the purchases ( promotion and use) of said Covid-19 test kits in 2017/18 do not breach the Fraud Act 2006 and Acts regarding the Govt.’s accountability.”

This is incredibly strange! World Bank website shows COVID-19 testing kits purchased by countries in 2017 and in 2018. I have verified that this is in fact posted on the World Banks World Integrated Trade Solution (WITS) website. WITS is a trade software provided by the World Bank for users to query several international trade databases. Working to learn more and bring a full report soon!

Social media users are sharing posts claiming the World Bank’s website shows that COVID-19 testing kits were purchased in 2017 and 2018, implying prior knowledge of the outbreak. This is false: the World Bank explained the products had only been relabelled with COVID-related descriptions in April 2020. Prior to that, the products had been listed since 2017, but not in relation to the pandemic.

According to WCO, product code 382200 corresponds to “diagnostic reagents based on polymerase chain reaction (PCR) nucleic acid test.”

In a statement released on September 8, the World Bank further clarified that because of misinformation posted on social media, the WITS site was “updated to reflect the reality: Covid-19 tests did not exist before 2020.

What a few days ago was labeled on WITS as a ‘Covid-19 Test Kit’ (using the WCO label) is now correctly labeled on the WITS Covid section as ‘Medical Tests.’

Patent disputes

The PCR technique was patented by Kary Mullis and assigned to Cetus Corporation, where Mullis worked when he invented the technique in 1983. The Taq polymerase enzyme was also covered by patents. There have been several high-profile lawsuits related to the technique, including an unsuccessful lawsuit brought by DuPont. The Swiss pharmaceutical company Hoffmann-La Roche purchased the rights to the patents in 1992. The last of the commercial PCR patents expired in 2017.

A related patent battle over the Taq polymerase enzyme is still ongoing in several jurisdictions around the world between Roche and Promega. The legal arguments have extended beyond the lives of the original PCR and Taq polymerase patents, which expired on 28 March 2005
